  I. IDENTIFICATION OF THE RESPONSIBLE.

In CHUCAO S.AP.I. DE C.V. hereinafter AZULIK® TRIBE with address at Carretera Tulum Ruinas, Km 5, Tulum, Quintana Roo, C.P. 77760; we inform you that the personal information of all our clients and potential clients is treated strictly confidential so that they can feel fully confident that when acquiring our goods and/or services, we make a permanent effort to safeguard and protect it.

  II. MEANS OF OBTAINING AND PERSONAL DATA COLLECTED.

AZULIK® TRIBE collects the following personal data necessary and applicable to comply with the purposes of this Privacy Notice, depending on the relationship that exists with you.

a)     Personal data that we collect personally:

Personal identification data, financial data, third party data (By providing the personal data of third parties, it is understood that you have the consent of the owner of the personal data). Due to the nature of the contract, we require your express written consent for the processing of your sensitive personal and financial data. (Note: By signing this Privacy Notice, you consent to the processing of your personal financial data with AZULIK® TRIBE.)

b)     Personal data that we collect directly through the website, email, and telephone.

Personal identification data, financial data, third party data (By providing the personal data of third parties, it is understood that you have the consent of the owner of the personal data).

c)     Personal data that we collect indirectly through third-party transfers and public access sources that are permitted by law.

Personal identification data.

If you participate in challenges, photography, events, and reports, you are informed that the images and sounds captured may be disseminated through internal communication media, websites, and different social networks. Likewise, the sounds collected through the different means used will be treated as support for monitoring the quality of our services.

  III.PURPOSES.

More than a policy, at AZULIK® TRIBE we have the philosophy of maintaining a close and active relationship with our clients and potential clients. In terms of the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (The Law) and its Regulations, the personal data you provide will be used for the following purposes:

  a. Necessary for the provision of the service:

                 i.     Carry out the formalities, procedures, and steps for the acquisition of goods, products, and/or services for our users and potential users.

                ii.     Capture ideas and unique creations provided by users for the development of projects through the publication of challenges on the page https://azuliktribe.com/

               iii.     Make the respective agreements or contracts related to the ideas and creations that have won a published challenge.

               iv.     Request information for the payment, where appropriate, of the payment of an economic benefit for the idea or creation that has been selected by AZULIK® TRIBE.

                v.     Make use of the winning ideas or creations in the project for which the user participated.

               vi.     Keep our records updated in order to respond to your queries.

              vii.     Process requests and clarifications.

            viii.     Comply with the laws, regulations, and other applicable legal provisions.

  b. Not necessary for the provision of the service:

1.     Carry out marketing, advertising, and commercial prospecting activities, different from the goods, products, and services provided by AZULIK® TRIBE.

2.     Carry out internal studies on consumer habits, marketing, advertising, and commercial prospecting related to the goods, products, and services offered by AZULIK® TRIBE.

3.     Follow up on our commercial relationship and request evaluation and follow-up to know the level of satisfaction of our goods, products, and services.

It is important to mention that the purposes (i), (ii), (iii), (iv), (v), (vi), (vii) and (viii) give rise and are necessary.

The purposes (1), (2), and (3) are not necessary but are important to offer you through marketing campaigns, advertising, and commercial prospecting, exclusive goods, products, and services, for which you have the right to object, or, to revoke your consent for AZULIK® TRIBE to stop processing your personal data for said purposes, in accordance with the procedure indicated in Section IV or V of this Privacy Notice. You are informed that you have a period of 5 business days to express your refusal regarding the processing of your personal identification data, in relation to the purposes of subsection (b) of this section, in accordance with the mechanism established in section IV of this Privacy Notice.

  IV. OPTIONS TO LIMIT THE USE OR DISCLOSURE OF YOUR PERSONAL DATA.

MYSTIKAL WANDERS informs you that, if you wish to stop receiving marketing, advertising, or commercial prospecting messages, related to the purposes referred to in subsection (a) of section III, you can enforce it via the email dataprotection@azuliktribe.comLikewise, we will hereby answer your questions and comments about the processing of your personal data.

  V. REQUEST FOR ACCESS, RECTIFICATION, CANCELLATION, OR OPPOSITION OF PERSONAL DATA (ARCO RIGHTS) AND REVOCATION OF CONSENT.

All your personal data are treated in accordance with the applicable and current legislation in the country, therefore we inform you that you have at all times the right to access, rectify, cancel, or oppose the treatment that we give to your personal data, as well to revoke the consent granted for the treatment of the same; rights that you can enforce through the manager on duty at reception, the area that AZULIK® TRIBE has designated for this purpose, or by sending an email to dataprotection@azuliktribe.com, so that the Rights Request Form ARCO may be provided, which must be submitted at the address of the Responsible Party, and must attach a copy of their official identification to prove their ownership. The response to your request for ARCO Rights will be sent to the email you have provided, within 20 business days from the receipt of said request. Likewise, you are informed that the right of access will be considered fulfilled when the corresponding response is sent through the email that you have indicated for this purpose.

The exercise of ARCO Rights will be free, where appropriate, the owner must cover the costs of shipping, reproduction, and/or certification of documents; however, if the holder exercises the same right in a period not exceeding 12 months, the response to the request will have a cost that will not exceed three days of the general minimum wage in force in Mexico City, Mexico. If you do not agree to the processing of your personal data, you can go to the INAI.

  VI. TRANSFERS OF PERSONAL DATA.

Transfers without consent:

You are informed that in order to comply with the purposes established in section (a), subsection IV of this Privacy Notice, your personal data may be transferred and processed within and outside Mexico by persons other than AZULIK® TRIBE. In this sense and based on the Law and its Regulations, your personal data may be transferred without your consent to: (i) Third-party service providers for the development of projects or winning ideas solely and exclusively for the fulfillment of the development of the project (ii) Third-party service providers, solely and exclusively for the fulfillment of the development of the project or winning idea for the purposes established in section (a) subsection (III) of this Privacy Notice; (iii) To third parties to carry out procedures in case of non-compliance and (iv) to national and international authorities in case of judicial requirement.

Consent transfers:

AZULIK® TRIBE may transfer your personal identification data to marketing and advertising companies for the purposes described in section (b) of subsection III of this Privacy Notice and to other hospitality, art, product, and service companies with which we have any commercial and/or business relationship to grant you benefits when acquiring them. If you do not want your personal data to be transferred to said third parties, you can express your refusal in accordance with the procedure established in section IV of this Privacy Notice.

  VII. USE OF COOKIES.

AZULIK® TRIBE informs you that it will not use "cookies and web beacons" to automatically obtain personal information from you. The personal data that we collect electronically, as well as the purposes of the treatment, are established in this Privacy Notice.

  VIII. MODIFICATIONS TO THE PRIVACY NOTICE.

This Privacy Notice may be modified from time to time by AZULIK® TRIBE, said modifications may be consulted through the following means:

1.     Notices visible in our AZULIK® TRIBE facilities.

2.     Any other means of oral, printed, or electronic communication that AZULIK® TRIBE determines for this purpose.

Aviso de Privacidad

I.  IDENTIFICACIÓN DEL RESPONSABLE.

En CHUCAO S.AP.I. DE C.V. en lo sucesivo AZULIK® TRIBE con domicilio en Carretera Tulum Ruinas, Km 5, Tulum, Quintana Roo, C.P. 77760; le comunicamos que la información personal de todos nuestros clientes y clientes potenciales es tratada de forma estrictamente confidencial, por lo que podrán sentirse plenamente seguros de que al adquirir nuestros bienes y/o servicios, hacemos un esfuerzo permanente para salvaguardarla y protegerla.

II. MEDIOS DE OBTENCIÓN Y DATOS PERSONALES QUE SE RECABAN. 

AZULIK® TRIBE recaba los siguientes datos personales necesarios y aplicables para dar cumplimiento a las finalidades del presente Aviso de Privacidad, dependiendo de la relación que con usted exista.

a. Datos personales que recabamos de manera personal:

Datos personales de identificación, financieros, datos de terceros (Al proporcionar los datos personales de terceros, se entiende que cuenta con el consentimiento del titular de los datos personales). Por la naturaleza del contrato, requerimos su consentimiento expreso y por escrito para el tratamiento de sus datos personales sensibles y financieros. (Nota: Al firmar el presente Aviso de Privacidad, otorga su consentimiento para el tratamiento de sus datos personales financieros con AZULIK® TRIBE.)

b. Datos personales que recabamos de manera directa a través de página web, correo electrónico y vía telefónica.

Datos personales de identificación, financieros, datos de terceros (Al proporcionar los datos personales de terceros, se entiende que cuenta con el consentimiento del titular de los datos personales).

c. Datos personales que recabamos de manera indirecta a través de transferencias de terceros y fuentes de acceso públicos que están permitidas por la Ley.

Datos personales de identificación. 

Si usted participa en desafíos, tomas de fotografía, eventos y reportajes, se le comunica que las imágenes y sonidos captados, podrán ser difundidas a través de medios de comunicación interna, página electrónica y las distintas redes sociales. Asimismo, los sonidos recabados a través de los distintos medios utilizados serán tratados como soporte del seguimiento de la calidad de nuestros servicios.

III.FINALIDADES.

Más que una política, en AZULIK® TRIBE tenemos la filosofía de mantener una relación estrecha y activa con nuestros clientes y clientes potenciales. En términos de lo establecido por La Ley Federal de Protección de Datos Personales en Posesión de los Particulares (La Ley) y su Reglamento, los datos personales que nos proporcione serán utilizados para las siguientes finalidades:

a.    Necesarias para la prestación del servicio:

      i.    Realizar los trámites, procedimientos y gestiones para la adquisición de bienes, productos y/o servicios para nuestros usuarios y usuarios potenciales.

     ii.    Realizar la captación de ideas y creaciones únicas proporcionadas por los usuarios para el desarrollo de proyectos a través de la publicación de desafíos en la página https://azuliktribe.com/

    iii.    Realizar los convenios o contratos respectivos relacionados con las ideas y creaciones que hayan ganado un desafío publicado.

    iv.    Solicitar información para el pago, en su caso, del pago de un beneficio económico para la idea o creación que haya sido seleccionada por parte de AZULIK® TRIBE.

     v.    Hacer uso de las ideas o creaciones ganadoras en el proyecto para el cual participó el usuario. 

    vi.    Mantener actualizados nuestros registros para poder responder a sus consultas. 

   vii.    Procesar solicitudes y aclaraciones. 

  viii.    Cumplir con las leyes, reglamentos y demás disposiciones legales aplicables. 

b.    No necesarias para la prestación del servicio:

1.       Realizar actividades de mercadotecnia, publicidad y prospección comercial, diversas a los bienes, productos y servicios que brinda AZULIK® TRIBE. 

2.       Realizar estudios internos sobre hábitos de consumo, mercadotecnia, publicidad y prospección comercial relacionada con los bienes, productos y servicios que ofrece AZULIK® TRIBE.

3.       Dar seguimiento a nuestra relación comercial y solicitar la evaluación y el seguimiento para conocer el nivel de satisfacción de nuestros bienes, productos y servicios.

Es importante mencionar que las finalidades (i), (ii), (iii), (iv), (v), (vi), (vii) y (viii) dan origen y son necesarias.

Las finalidades (1), (2) y (3) no son necesarias, pero son importantes para ofrecerle a través de campañas de mercadotecnia, publicidad y prospección comercial, bienes, productos y servicios exclusivos, por lo que usted tiene derecho a oponerse, o bien, a revocar su consentimiento para que AZULIK® TRIBE deje de tratar sus datos personales para dichas finalidades, de acuerdo con el procedimiento señalado en el apartado IV o V del presente Aviso de Privacidad. Se hace de su conocimiento que cuenta con un plazo de 5 días hábiles para manifestar su negativa respecto al tratamiento de sus datos personales de identificación, en relación con las finalidades del inciso (b) de este apartado, conforme al mecanismo establecido en el apartado IV del presente aviso de Privacidad.

IV.   OPCIONES PARA LIMITAR EL USO O DIVULGACIÓN DE SUS DATOS PERSONALES.

MYSTIKAL WANDERS le comunica que, si usted desea dejar de recibir mensajes de mercadotecnia, publicidad o de prospección comercial, relativos a las finalidades referidas en el inciso (a) del apartado III, puede hacerlo valer a través del correo electrónico dataprotection@azuliktribe.com, así mismo, por este medio atenderemos sus dudas y comentarios acerca del tratamiento de sus datos personales.

V.    SOLICITUD DE ACCESO, RECTIFICACIÓN, CANCELACIÓN U OPOSICIÓN DE DATOS PERSONALES (DERECHOS ARCO) Y REVOCACIÓN DE CONSENTIMIENTO.

Todos sus datos personales son tratados de acuerdo a la legislación aplicable y vigente en el país, por ello le informamos que usted tiene en todo momento el derecho de acceder, rectificar, cancelar, u oponerse al tratamiento que le damos a sus datos personales, así como revocar el consentimiento otorgado para el tratamiento de los mismos; derechos que podrá hacer valer a través del gerente en turno de recepción, área que AZULIK® TRIBE ha designado para tal efecto, o bien, enviando un correo electrónico a dataprotection@azuliktribe.com, para que le sea proporcionado el Formato de Solicitud de Derechos ARCO, mismo que deberá presentar requisitado en el domicilio del Responsable, debiendo adjuntar una copia de su identificación oficial para acreditar su titularidad. La respuesta a su solicitud de Derechos ARCO se le hará llegar al correo electrónico que haya proporcionado, dentro del término de 20 días hábiles contados a partir de la recepción de dicha solicitud. Así mismo, se le informa que el derecho de acceso se tendrá por cumplido cuando se haga llegar la respuesta correspondiente a través del correo electrónico que usted nos haya indicado para tal efecto.

El ejercicio de los Derechos ARCO será gratuito, en su caso, el titular debe de cubrir los gastos de envío, reproducción y/o certificación de documentos; sin embargo, si el titular ejerce el mismo derecho en un periodo no mayor de 12 meses, la respuesta a la solicitud tendrá un costo que no excederá de tres días de salario mínimo general vigente en el Distrito Federal, México. En caso de no estar de acuerdo en el tratamiento de sus datos personales, puede acudir ante el INAI.

VI.   TRANSFERENCIAS DE DATOS PERSONALES.

Transferencias sin necesidad de consentimiento:

Se le informa que a fin de dar cumplimiento a las finalidades establecidas en el inciso (a), apartado IV del presente Aviso de Privacidad, sus datos personales pueden ser transferidos y tratados dentro y fuera de los Estados Unidos Mexicanos por personas distintas a AZULIK® TRIBE. En este sentido y con fundamento en La Ley y su Reglamento, sus datos personales podrán ser transferidos sin necesidad de su consentimiento a: (i) Terceros proveedores de servicios para el desarrollo de los proyectos o ideas ganadoras única y exclusivamente para el cumplimiento de del desarrollo del proyecto (ii)  Terceros proveedores de servicios, única y exclusivamente para el cumplimiento el desarrollo del proyecto o idea ganadora para las finalidades establecidas en el inciso (a) apartado (III) del presente Aviso de Privacidad; (iii) A terceros para realizar gestiones en caso de incumplimiento y (iv) a Autoridades nacionales e internacionales en caso de requerimiento judicial. 

Transferencias con consentimiento:

AZULIK® TRIBE podrá transferir sus datos personales de identificación a empresas de marketing y publicidad para las finalidades descritas en el inciso (b) del apartado III del presente Aviso de Privacidad y a otras empresas de hospitalidad, arte, productos y servicios con las que tengamos alguna relación comercial y/o de negocios con la finalidad de otorgarle beneficios al adquirirlos. Si usted no desea que sus datos personales sean transferidos a dichos terceros, puede manifestar su negativa conforme al procedimiento establecido en el apartado IV del presente Aviso de Privacidad. 

  VII.  USO DE COOKIES.

AZULIK® TRIBE le informa que no utilizará “cookies y web beacons” para obtener información personal de usted de manera automática. Los datos personales que recabamos de manera electrónica, así como las finalidades del tratamiento se encuentran establecidas en el presente Aviso de Privacidad. 

VIII. MODIFICACIONES AL AVISO DE PRIVACIDAD.

Este Aviso de Privacidad podrá ser modificado de tiempo en tiempo por AZULIK® TRIBE, dichas modificaciones podrán consultarse a través de los siguientes medios:

1.       Avisos visibles en nuestras instalaciones de AZULIK® TRIBE.

2.       Cualquier otro medio de comunicación oral, impreso o electrónico que AZULIK® TRIBE, determine para tal efecto.
